Article 2 - Applicability & Terms

  1. Our general terms and conditions apply to every offer made by us as a Web Retailer to you as a Consumer (any natural person who, exclusively for non-professional purposes, acquires or uses products or services placed on the market).
  2. We only deliver to countries within the European Union. If you provide a delivery address in another country, we may refuse your order.
  3. To place an order, you must be at least 18 years old. If you are not 18, we ask you to have the order placed by your parents or legal guardian. If we notice that an order has been placed by a minor, we may refuse this order.
  4. Placing an order on the website constitutes express acceptance of our general terms and conditions, which are always available on the website.
  5. When you order online, we will also provide you with a copy of these general terms and conditions along with the order confirmation or at the latest upon delivery in a format that you can save or print. We recommend that you always do so.
  6. If additional specific conditions apply in addition to these general terms and conditions, the above also applies to those specific conditions. If our general terms and conditions conflict with those specific conditions, you, as a consumer, can always invoke the most favorable text in your favor.

Article 3 - Our Offer and Your Order

  1. If an offer has a limited validity period or is subject to certain conditions, we will expressly mention this in our offer.
  2. We always describe as completely and accurately as possible what we are selling and how the ordering process will proceed. The description is in any case sufficiently detailed to allow you to make a proper assessment. If we use images, these are a true representation of the goods and/or services offered. However, mistakes can occur, and if we have clearly made a mistake, we are not obliged to deliver to you.
  3. Your order is complete, and the agreement between us is final once we confirm your order by email and once we have received the approval of the card issuer for your payment transaction with credit or debit cards. We accept payments via Bancontact, Maestro, Visa, MasterCard, American Express, China Union Pay, Alipay, and bank transfer. If the issuer of your card refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
  4. To purchase a product, you add the product to your shopping cart. Then you enter your contact details and billing information. Next, you choose your method of delivery: send to a specified address or pick up at one of our stores. In the final step, you will be presented with an overview page, where you accept our general terms and conditions and confirm your payment by pressing the order button with the caption "order with payment obligation." Once you have completed these steps, your purchase is final.

Article 4 - Right of Withdrawal

  1. If you purchase goods from us, you have the right to decide that you do not wish to keep the goods within 14 days from the date of delivery. You can then return your order without a penalty and without giving any reason (the cost of this is at your expense). Within 30 days after we have received your return, we will refund you the full purchase price via a bank transfer. You must provide your bank details so that we can initiate the refund procedure.
  2. The direct costs of returning the goods are at your expense. We will indicate the cost of this or make an estimate if it cannot reasonably be calculated in advance.
  3. We provide a refund period of up to 30 days after we have received your order back in the same condition as it was sent.
  4. During the first 14 days after delivery, we expect you to handle the order and packaging with care. If you want to return the goods as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep the goods. Returned goods may be tried on, but not used. If you return the goods, this must be done together with the original packaging, with all supplied accessories and in the original condition and packaging, taking into account our instructions below.
  5. You can return your return package by post, courier, or in one of our stores.
  6. To exercise your right of withdrawal quickly and correctly, you must complete the Return Form and send it to info@colman.be or Colman Antwerp, Eiermarkt 7 box 1, 2000 Antwerp, Belgium. We will send you an acknowledgment of receipt of your withdrawal by email.

Article 5 - The Price

  1. During the period mentioned in our offer, our prices do not change, except for price changes due to changes in VAT rates.
  2. Our prices include all taxes, VAT, duties, and services. You will never be surprised. However, we may decide to charge shipping costs in addition to the purchase price. In that case, we will always notify you before you finalize your purchase.

Article 6 - Payment

  1. We can only accept payment through the payment modules on our website.
  2. To ensure secure online payment and the security of your personal information, transaction data is transmitted over the Internet using SSL technology. You do not need special software to make an SSL payment. You can recognize a secure SSL connection by the "lock" icon in the lower status bar of your browser.

Article 7 - Compliance and Warranty

  1. We guarantee that our goods conform to your order and meet the normal expectations you may have considering the specifications of the product. We also guarantee that our goods comply with all existing laws at the time of your order. A gemological certificate from GIA or HRD is issued for every diamond larger than 1 carat.
  2. Furthermore, as far as the delivery of goods is concerned, we apply the legal minimum warranty period of two years if the product is not in conformity with the placed order. This means that for defects or defects in the product, which are not caused by incorrect manipulation, this product will be repaired free of charge up to 2 years after delivery.
  3. Some products also come with a manufacturer's warranty. This warranty does not affect the legal warranty. Every product sold also comes with at least a two-year manufacturer's warranty, if this period is longer, it will be indicated. If this warranty is not internationally supported by the manufacturer, Jeweler Colman will handle the warranty case for you.

Article 8 - Delivery and Execution

  1. All goods are delivered to the address you provided when placing your order.
  2. When an item is in stock, it will be delivered to your delivery address within 1 to 4 working days. If an item is not in stock but you still wish to order it, we will attempt to deliver the product within 30 days. In this case, we will inform you of the possible delivery time.
  3. Deliveries are made via a courier service using standard service; if you require express delivery, the delivery costs will be charged to you. Deliveries will be made on working days between 08:00 and 18:00 at the address you provided.
  4. If we are unable to deliver on time, we will always notify you before the expiry of the expected delivery period. If we fail to do so, you are entitled to cancel your order free of charge. In that case, we will refund you within 30 days after cancellation.
  5. Our shipments are always at our risk. So, you don't need to worry about goods that get lost in the mail. However, if you return goods to us within 14 days of purchase because you do not wish to keep them, you are responsible for the transport.
  6. If the goods delivered by us are damaged during transport, do not correspond to the items listed on the delivery note, or do not match the items you ordered, you must notify us as soon as possible, but no later than within 3 days, and return the items to us within 14 calendar days of receipt. For this purpose, you should use the "return form," which you can download and save here. If you have any questions when completing this return form, you can contact one of our employees at the email address info@colman.be.

We cannot be held responsible for any consequential damage due to late delivery or non-delivery by the carrier appointed by the company. In such cases, our liability is limited to the value of the items that have been demonstrated not to have been received by the customer.

Article 9 - Force Majeure

  1. In case of force majeure, we are not obliged to fulfill our obligations. In that case, we can either suspend our obligations for the duration of the force majeure or definitively terminate the agreement.
  2. Force majeure is any circumstance beyond our will and control that wholly or partially prevents the fulfillment of our obligations. This includes, among other things, strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunication) network or connection, or the unavailability of our website at any time, non or untimely delivery by suppliers or other third parties involved, ...

Article 10 - Intellectual Property

  1. Our website, logos, texts, photos, names, and, in general, all our communication are protected by intellectual property rights, whether owned by us, our suppliers, or other rights holders.
  2. It is prohibited to use or make changes to the intellectual property rights as described in this article. For example, you may not copy or reproduce photos, names, texts, logos, color combinations, etc., without our prior and express written permission.

Article 11 - Complaints Procedure and Disputes

  2. All agreements we conclude with our customers, regardless of their place of residence, are governed exclusively by Belgian law, and only Belgian courts are competent in case of disputes. If, for reasons of international law, another law is nevertheless applicable, the interpretation of these general terms and conditions will, in the first instance, refer back to Book VI of the Belgian Economic Code.
